NCPP BOOT CAMP: Patent Prosecution – Claim Scope, Amendments, and Effects on Litigation

FreeNCPP BOOT CAMP OBJECTIVES
- How to amend claims no more than necessary in order to achieve desired claim scope, while avoiding unnecessary amendments that may narrow the scope of a claim
- How to respond to office actions in a way that does not create issues later in litigation (e.g., working to avoid prosecution history estoppel, unintentional narrowing of claims, or improper/unnecessary characterizations of the prior art); and;
- How to utilize examiner interviews to ensure a “cleaner” prosecution history.
- Drafting responses to office actions in view of potential litigation (e.g., don’t say too much, do not characterize claim language, prosecution history estoppel)
